EssNetz GmbH \u2013 Terms & Conditions (T&C) – English<\/b><\/h1>\n

1. Introduction<\/b><\/h2>\n

Welcome to EssNetz GmbH (“EssNetz,” “we,” “us,” or “our”).
By subscribing to and using our meal delivery services, you agree to these Terms & Conditions (T&C).<\/p>\n

2. Subscription Terms<\/b><\/h2>\n

2.1 Subscription Period & Automatic Renewal<\/b><\/h3>\n

  • Monthly Subscription: The subscription is valid for one month and renews automatically unless canceled.<\/li>\n
  • Meal Start Date: Meals are delivered 7 days after the subscription date. If the 7th day falls on a weekend or public holiday, meals start on the next working day.<\/li>\n
  • Billing Cycle:\n

    • The first subscription payment is charged immediately upon sign-up.<\/li>\n
    • Future payments are charged on the same day each month based on the first payment date.<\/li>\n
    • Example: If you subscribe on October 1st, your meals start on October 7th, and the next charge is November 1st.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n

      2.2 Subscription Renewal & Price Adjustments<\/b><\/h3>\n

      • Subscriptions renew automatically unless canceled before the renewal date.<\/li>\n
      • Changes to plans (upgrade\/downgrade) take effect in the next billing cycle.<\/li>\n
      • EssNetz reserves the right to adjust prices with 30 days’ notice to users.<\/li>\n<\/ul>\n

        3. Cancellation & Refund Policy<\/b><\/h2>\n

        3.1 Right of Withdrawal (14-day Cooling-off Period)<\/b><\/h3>\n

        • Users may cancel their subscription within 14 days of sign-up.<\/li>\n
        • Meals consumed during this period will be charged according to the selected plan.<\/li>\n<\/ul>\n

          3.2 Subscription Cancellation<\/b><\/h3>\n

          • After the 14-day withdrawal period, cancellations are only valid before the next renewal date.<\/li>\n
          • Example: If your subscription renews on April 5th, you must cancel by April 4th to avoid being charged again.<\/li>\n<\/ul>\n

            3.3 Refunds & Meal Carry-Forward<\/b><\/h3>\n

            • No refunds are given for unused meals or late cancellations.<\/li>\n
            • Carry-forward meals: Unused meals may be rolled over to the next month (limits apply based on plan).<\/li>\n<\/ul>\n

              3.4 Cancellation Confirmation & Plan Changes<\/b><\/h3>\n

              • EssNetz confirms cancellations within 48 hours via email.<\/li>\n
              • Plan changes (upgrade\/downgrade) take effect in the next billing cycle.<\/li>\n
              • Immediate cancellation allowed if EssNetz modifies key terms (e.g., price increase).<\/li>\n<\/ul>\n

                4. Payment & Failed Transactions<\/b><\/h2>\n

                4.1 Accepted Payment Methods<\/b><\/h3>\n

                • EssNetz accepts Credit Cards, PayPal, and SEPA direct debit.<\/li>\n
                • Users authorize automatic recurring payments by subscribing.<\/li>\n<\/ul>\n

                  4.2 Failed Payments<\/b><\/h3>\n

                  • If a payment fails, EssNetz notifies the user and retries the charge within 7 days.<\/li>\n
                  • If the issue remains unresolved, the subscription is paused, and no meals are delivered until payment is successful.<\/li>\n<\/ul>\n

                    • Users must verify if EssNetz delivers to their area before subscribing.<\/li>\n
                    • EssNetz does not guarantee meal availability and may offer alternative meals if necessary.<\/li>\n<\/ul>\n

                      5.2 Delivery Failures & Force Majeure<\/b><\/h3>\n

                      • EssNetz is not responsible for delivery delays caused by:\n
                          \n
                        • Strikes, transportation failures, natural disasters.<\/li>\n
                        • Government restrictions or unforeseen events.<\/li>\n<\/ul>\n<\/li>\n
                        • If a meal cannot be delivered, EssNetz provides a credit for a replacement meal, but no cash refunds.<\/li>\n<\/ul>\n

                          5.3 Responsibility of Delivery Partners<\/b><\/h3>\n

                          • EssNetz coordinates delivery but does not directly handle it.<\/li>\n
                          • EssNetz is not liable for delays, cold meals, or incorrect deliveries\u2014these are the responsibility of the delivery partner.<\/li>\n
                          • Users must report delivery issues within 2 hours to be eligible for a resolution.<\/li>\n<\/ul>\n

                            6. User Responsibilities & Fair Use Policy<\/b><\/h2>\n

                            6.1 Account Usage & Misuse<\/b><\/h3>\n

                            • Users must provide accurate registration details.<\/li>\n
                            • EssNetz may suspend accounts for:\n
                                \n
                              • Fraudulent cancellations or chargebacks.<\/li>\n

                                • EssNetz aims for high-quality meals but cannot guarantee 100% allergen-free food.<\/li>\n
                                • Users must check allergen information before selecting meals.<\/li>\n<\/ul>\n

                                  • EssNetz is not liable for:\n

                                    • User mistakes (e.g., forgetting to select meals).<\/li>\n
